Rezumat

Both the “European” and the “American” model of constitutional justice can not protect the individual from the public authority’s over-indulgence in case the law court does not interpret the legislation it applies in judicial acts in the spirit of the Constitution. The constitutional complaint is a subsidiary form of appeal, accessible to everyone, applied in the field of the constitutional justice, after exhausting the ordinary ways of appeal. This form of appeal claims the encroachment of an individual right by a public authority in a jurisdictional public or administrative act. The individual’s possibilities of direct access to the constitutional justice differ from state to state, in the opinion of the author the most universal and viable is the German model. In 2005, 1,75 constitutional complaints have been lodged to the ECHR, reported to 10000 citizens, in great measure because of the lack of constitutional complaint procedure; in Germany, at the same number of citizens, in that period have been lodged 0,19 complaints.
