Rezumat

Являясь правовым документом широкого резонанса, Европейская конвенция по защите прав человека и фундаментальных свобод, принятая 4-го ноября 1950 г., является самой развитой и разработанной моделью в области защиты и гарантии прав человека и основных свобод, сквозь широкий спектр прав и свобод, которым предано признание и гарантия. Свобода выражения мнения в соответствии со ст. 10, является не только краеугольным камнем демократии, но и необходимым условием осуществления многочисленных прав и свобод, закрепленных в Европейской конвенции по защите прав человека и основных свобод. Ст. 10, без сомнения, считается одной из главнейших основ демократического сообщества, одним из основных условий прогресса, развития каждого человека. Свобода, гарантированная в ст. 10, относится ко всем областям человеческой деятельности, включая искусство, науку, культуру или политику. Она является одним из эффективных внедрений таких определений как плюрализм, толерантности и дух без которых Европейский суд по правам человека демонстрирует, что невозможно говорить о демократическом обществе. Тем не менее, защищенное право, закрепленное в ст. 10 из Конвенции не является абсолютным. Ст. 10 имеет похожую структуру с другими статьями, названными «из той же категории», которые утверждают ограничения от использования защищенной свободы выражения, идентифицируя в первом абзаце, защиту, а во втором - причины их ограничения, предоставляя особенности, которые отличают еѐ и одновременно дополняют судебную практику в данной области. В связи с этим, первый абзац исключает «режим авторизации радиовещательных компаний, телевизионных компаний или кино» из категории незаконного количества органов государственной власти. Кроме того, данная система выделяет три составляющие свободы слова: свободу убеждений, свободу получения информации и идей и свободу распространения информаций и идей. Последние две в совокупности являются свободой общения. Второй абзац ст. 10 является менее ограничительным, в сравнении с теми, что содержатся в ст. 9 и 11, и дает государствам гораздо больше пространства для действий. Это исходит из контекста самого текста, который указывает ограничения в ст. 10, тогда как в других, льготы или вмешательства носят исключительный характер. Таким образом, свобода выражения мнения, которая влечет за собой обязанности и ответственность, может быть отнесена к определенным формальностям, условиям, ограничениям или санкциям, предусмотренные законом и необходимые в демократическом сообществе, национальной безопасности, территориальной целостности или общественной безопасности, обеспечении порядка и борьбе с преступностью, здоровья и нравственности, защите репутации или прав других лиц, предотвращении разглашения конфиденциальной информации и беспристрастности правосудия. Ограничительные положения, содержащиеся во втором абзаце, довольно велики. Для того, чтобы быть уверенными в том что государства не злоупотребляет обширными данными, бывшая Европейская комиссия по правам человека установила строгие правила толкования этих положений, разработав в деле Sunday Times против Объединенное Королевства, правило строгого толкования, согласно которому строгое толкование означает, что никакие другие критерии, кроме указанных в исключительном положении не могут оправдать данное ограничение каким бы оно ни было, в свою очередь данные критерии должны быть истолкованы таким образом, чтобы их содержание соответствовало их обычной интерпретации.

Being a legal instrument of a broad resonance, the European Convention on Human Rights and Fundamental Freedoms, adopted on 4th November 1950, is the most evolved and developed model in protecting and guaranteeing human rights and fundamental freedoms, through the wide range of rights and freedoms to which is devoted the recognition and guarantee. The right of Freedom of expression, under Article 10, is not only a cornerstone of democracy, but also a prerequisite for the exercise of numerous other rights and freedoms registered in the European Convention on Human Rights and Fundamental Freedoms. Article 10 is without doubt one of the essential foundations of a democratic society, one of the primary conditions of its progress, of the development of each individual. The freedom, guaranteed under Article 10, is being assigned to all areas and domains of human activity including art, science, culture or politics. It is one of the efficient implementation of the notion of pluralism, tolerance and spirit of the European Court of Human Rights shows that it is impossible to speak about a democratic society. However, the right protected by Article 10 of the Convention is not one absolute. Article 10 has a similar structure to other articles, named “from the same category”, which authorizes restrictions from exercising the protected liberties, stating in the first paragraph protection, and in the second paragraph the reasons for restricting them, showing features that distinguish it and simultaneously enrich the jurisprudence in this area. In this connection, the first paragraph excludes “the authorization scheme of the business of broadcasting, television or cinema” from the category of unlawful interference of the public authorities. Also, in this case are evidenced three components of the freedom of expression: freedom of opinion, freedom to receive information and ideas and freedom to impart information and ideas. The last two overall represent the freedom of communication. Second paragraph of Article 10 is much less restrictive than those of Articles 9 and 11 and offers to the states a much larger work space. This results from the text itself which expressly authorizes the restrictions in Article 10 where in other cases, exemptions or interference has an exceptional nature. Therefore, the exercising of freedom of expression that carries out obligations and responsibilities may be a subject to such formalities, conditions, restrictions or penalties that are prescribed by law, constitutes necessary measures in a democratic society, for the national security, territorial integrity or public safety, defending policy and crime prevention, health protection or morals, protection of the reputation or rights of the others, for preventing the disclosure of confidential information or for maintaining the authority and impartiality of the judiciary. The restrictive clauses contained in the second paragraph are quite large. For being ensured that the states are not abusing this extensive character, the former European Commission of Human Rights has established a strict rule of interpretation of these clauses, formulating in the case of the Sunday Times c. UK the rule of strict interpretation, according to which a strict interpretation means that not any other criteria than those specified in the exception clause cannot justify this restriction whatever it would be, these criteria themselves must be interpreted so that their contents should correspond to their usual acknowledge.
