Rezumat

Пропорциональность вносит в правовую систему некий строгий элемент, характерный в первую очередь точным наукам. В результате пропорциональность является вопросом, например в том, что касается соразмерности наказания или вопроса о прогрессивности налога и т.д. Это означает что предписание пропорциональности продиктовано существованием некой свободы действия имеющей определенные пределы. Для того чтобы данный принцип нашел свое применение он должен установить правомерное толкование текста. В этом смысле пропорциональность исходит не только из толкования права, но также из практики его применимости и может быть адресован любому органу, обладающему соответствующей властью, независимо от того идет ли речь о законодателе, администраторе, судье или о частном лице. Обращение к контролю пропорциональности со стороны конституционных юрисдикций не является чем-то новым. Правильнее будет сказать, что это забытая практика, существовавшая ещѐ до создания данных юрисдикций. Данное постоянство мы находим и в системе романо-германского права и в системе общего права. Целью данной статьи является проведение сравнительно-правового анализа относительно места и роли принципа пропорциональности в правовых системах некоторых государств, а также его применимости конституционными юрисдикциями данных государств.

The proportionality seems to introduce a rigid element of count in the legal system, characteristic first of all to the exact sciences. As a result, proportionality is a question especially in the regard to proportionality of punishment or a question on the progressiveness of the tax and etc. It means that the proportionality instruction is dictated by existence of certain freedom of action having certain limits. In order the abovementioned principle would found its application it should establish a legitimate interpretation of the text. In this sense a proportionality proceeds not only from the interpretation of the law, but also from the practice of its applicability and can be addressed to anybody possessing the corresponding power, regardless of whether it is legislator, administrator, judge or private person. An appeal to the control of proportionality from the constitutional jurisdictions isn't something new. It should be more correct to say that this is a forgotten practice which existed before the creation of these jurisdictions. This constancy is found in the romano-germanic law and in common system. The aim of the present article is to perform a comparative study of the place and role of the principle of proportionality in the legal order of certain states and its reflection in their constitutional jurisdiction.
