Rezumat

În studiu e prezentată raţiunea armonizării legislaţiei Republicii Moldova cu legislaţia UE, din punct de vedere al bazei de asigurare a securităţii naţionale. Pornind de la aceea, că securitatea naţională concentrează în interiorul său componenta multilaterală, care indusă, înainte de toate, asupra multivectorialităţii constituirii bazei sale, accentul asupra componentei energetice nu ridică semne de întrebare. Mai degrabă invers, problema energetică prezintă o importanţă strategică pentru ţările, dezvoltarea economică a cărora, în condiţiile lipsei permanente a stabilității preţurilor la resursele energetice, depinde de import. De aici şi abordarea diferenţiată a problemei energetice. În condiţiile reale, nu e complicat de presupus logica comportării unor astfel de state pe arena internaţională. Luând în considerare importanţa geopolitică a factorului energetic în lumea contemporană, ele, în esenţă, aflându-se între necesitatea şi obligativitatea rezolvării problemei energetice şi, gândind în categoriile securităţii naţionale (interesul naţional, ameninţarea securităţii şi sistemul de asigurare a ei), permanent sunt în căutarea noilor forme și metode de soluționare a problemei. În această privinţă, Republica Moldova, fiind, în sistemul mondial, un actor energetic dependent şi energodeficitar, nu cedează deloc în privinţa acestui indicator altor state. Priorităţile şi direcţiile politicii energetice externe a statului sunt strâns legate de piaţa energetică a Uniunii Europene. Într-un stil pur juridic ne referim la armonizarea legislaţiei energetice a Moldovei cu legislaţia Uniunii în acest domeniu. Unica chestie ce ne poate îngrijora în această privință – e dependenţa reală a însăşi UE de importul purtătorilor energetici, care în viitor doar va creşte, ajungând la indicatori alarmanţi. Conform calculelor propuse, consumul importurilor de gaz în Uniune în anul 2030 poate creşte de la 57% la 84%, a petrolului – de la 82% la 93%. În această privinţă e logic de a aborda problematica raţiunii aderării Moldovei la piaţa energetică a Europei, care, şi fără de aceasta, e sensibilă, cât şi a armonizării legislaţiei în domeniu. Însă, din start, nu întâmplător am remarcat, că ţările, neliniştite de propriul statut energodeficitar, destul de des apelează la o abordare diferenţiată a problemei energetice.

The article is an analysis of expediency of harmonization of energy legislation of the Republic of Moldova with the EU legislation in terms of basic national security. Based on the fact that national security concentrates inside itself predominantly a multifaceted component, pointing primarily on the versatile coherence of its framework, the emphasis on the energy component doesn't cause any doubts. On the contrary the energy issue represents a strategic importance for the states which economic development in the conditions of constant instability of the world prices for energy carriers completely depends on their import. This explains the existence of the differentiated approach to energy issues. In real conditions logic of behavior of such states in the international arena is not complex to de understood. Considering a geopolitical importance of energy factor in the modern world, they, as a matter of fact, being between the need and necessity to resolve the energy issue and, thinking in terms of national security (national interest, the security threat and its system) analyze their energy vulnerability through the prism of direct threat to their security. In this regard, the Republic of Moldova, being a volatile and energy deficit actor of world system, doesn't concede to other states on the given indicator. Priorities and directions of external energy policy of the state are closely related to the EU energy market. In a purely legal manner it is a question of harmonization of energy legislation of the Republic of Moldova with the Union legislation in this field. The only thing that could guard us on this point is a real dependence of the EU on import of energy carriers that will increase, reaching the alarming figures. According to the presented calculations, consumption of gas by the Union in 2030 can increase from 57 % to 84 %, oil – from 82 % to 93 %. Thereupon it would be lawful to wonder about the advisability of Moldova’s accession to the energy market of already energetically vulnerable Europe and legislation harmonization, consequently. However initially we have not casually noticed that the states disturbed by their energy deficit status very often resort to differentiated approaches on the energy issue.
