Rezumat

Важность концептуального обоснования правового статуса комбатанта, обусловлена, прежде всего, тем, что данный вопрос, являясь предметом острых споров, все больше стал привлекать внимание юристов-международников. Вместе с тем, проблема прав и обязанностей лиц, вытекающих из правового статуса комбатанта одна из краеугольных в международном гуманитарном праве. В настоящее время значительное число происходящих в мире вооруженных конфликтов обладает немеждународным характером, что приводит к множеству осложнений в том, что касается определения правового статуса участников этих конфликтов, их прав и обязанностей, рассматриваемых в контексте статуса комбатанта. Сложность определения правого статуса комбатанта заключается в том, что комбатант, попадающий в руки противника, должен получить статус военнопленного, то есть статус, который исключает возможность привлечения его к ответственности за участие в военных действиях до попадания в плен (за исключением случаев, когда этим лицом были совершены международные преступления, предусмотренные Женевскими конвенциями). Самая важная гарантия, которую предоставляет статус комбатанта, заключается в отсутствии уголовного наказания за простое участие в военных действиях. Неоспорим тот факт, что лица, подозреваемые в военных преступлениях или преступлениях против человечности, а также те, кто совершил подобные нарушения закона, не могут претендовать на амнистию, тем более что эти категории преступлений не имеют срока исковой давности. Таким образом, участие в военных действиях, осуществленное в строгом соответствии с нормами международного гуманитарного права, не представляет собой достаточное основание для привлечения комбатанта к ответственности, в то время как лица, не принадлежащие к категории комбатантов, несут ответственность за простое участие в военных операциях, выполняемых в рамках современных вооруженных конфликтов.

The importance of conceptual substantiation of the legal status of combatants is caused, first of all, by the fact that this issue, being a subject of heated debate in recent years increasingly began to attract the attention of international lawyers. However, the issue of the rights and obligations generated the legal status of combatants is one of the cornerstones of international humanitarian law. For the meantime, the vast majority of armed conflicts that take place in the whole world have a noninternational nature, the fact that generates a lot of difficulties as refers to the determination of legal statute of persons that participate in these armed operations, their rights and obligations, which have to be obeyed taking in consideration the legal statute of combatant. The complexity of determining the legal status of a combatant is that combatants falling into enemy hands should beneficiate the status of prisoner of war, i.e. status, which excludes the possibility of bringing him to justice for participation in hostilities before falling into captivity (except for cases when this person had been committed the international crimes provided by the Geneva conventions). The most important warranty that is given by the statute of combatant is the absence of criminal punishment for the simple participation in the hostilities. It is beyond controversy that the persons suspected in war crimes or crimes against humanity or those that have committed such violations of law won’t have the possibility to take advantage of amnesty for their acts, the more so, because these kinds of crimes have no term of prescription. In this case, the participation in hostilities, conditioned by the absolute observation of the international humanitarian norms, does not constitute a sufficient motive for prosecution of the combatant, whereas persons who cannot be included in the category of combatants will be prosecuted for the simple participation in the hostilities in time of contemporary armed conflicts.
