Rezumat

Статья посвящена истории формирования и развития института международной защиты прав женщин, как самостоятельной ветви международного права прав человека. Автор анализирует международные документы данной области, доктринальные тексты, а также эффективность существующих универсальных механизмов защиты прав женщин. Проблематика «права человека», которая на первый взгляд может показаться характерной исключительно для XX в., не является абсолютно новой в истории человечества. Данная идея известна с древних времен. Так примерно в 300 до н.э. в греко-римской философии, основанной Зеноном из Китиона, она получила свое первое теоретическое освещение. Именно ему принадлежит идея, согласно которой каждый индивид имеет право претендовать на уважение своего человеческого достоинства. Регламентация и защита прав женщины и связанная с ними имплементация международных норм о правах женщины сталки вается с дополнительными трудностями. Поскольку женский вопрос охватывает практически все стороны жизни общества и его нельзя рассматривать как изолированную социальную проблему, он не может быть решен при помощи одних только норм права. Данный вопрос затрагивает та кие области общественных отношений, где нормы морали, обычаи и традиции глубоко воздействуют на весь процесс правового регулирования.

Article describes the history of formation and development of the institute of international women’s rights, as an independent branch of the international human rights law. The author analyzes the international instruments of that area, the doctrinal texts, as well as the effectiveness of existing mechanisms to protect the universal women’s rights. The issue of „human rights”, which at first glance may seem characteristic only for the XX century, is not entirely new in human history. This idea has been known since ancient times. Thus about 300 BC in Greco-Roman philosophy, founded by Zenon of Citium, it received its first theoretical coverage. It was he who originated the idea, according to which every individual has the right to claim respect for his dignity as a person. Regulation and protection of women’s rights and connected with them implementation of international norms on the rights of women face additional difficulties. Since women’s issue covers virtually all aspects of society it can’t be regarded as an isolated social issue, and therefore can’t be solved only one law. This issue affects such areas of public relations, where standards of morality, customs and traditions very deeply affect the whole process of legal regulation.
