The State’s right to grant diplomatic protection is based on the link of nationality between the injured individual and the State. It can be concluded that except extraordinary circumstance, a State may not extend its diplomatic protection or espouse claims of non-nationals. State practice, international conventions and more recently the European Convention on Nationality (1997) confi rmed that each State determines under its own law who are its nationals. However: - The State’s right to determine the nationality of the individual is not absolute; - Other States may challenge the absolute right to determinate nationality (1) where there exists insufficient connection between the State of nationality and the individual or (2) where nationality has been improperly conferred; - Human rights conventions require States to comply with international standards in the granting of nationality.
Double citizenship brings two distinct and complicated situations: 1. Diplomatic protection in case of dual nationality, when the individual is the national of both involved States; 2. Diplomatic protection in case of dual or multiple nationality, when the individual is not a national of the injuring State. |
