From the oldest times and until the two third of XIX century, the law under which a territory occupied by an enemy was considered its property had a general recognition. According to this rule, the occupier had the freedom to use the territory according to his will: to conquer it, allocate it, devastate it and rob it. His discretional powers were extended on its habitants as well, which could be killed, transformed into slaves and be sold etc. Further to this, experts start being preoccupied to legally regulate the situation of military occupation. In this way the first provisions regarding military occupation are developing, provisions which set the root of current occupational international law. |
