T he work deals with the following
issue: Colours per se and combinations
of colours eligible for registration as
trademarks.
Recently, the rapid development of technology
offered the consumers the opportunity to
perceive and the forms of less traditional
trademarks, acting in a specific manner upon
fillings, namely by means of colours, aromas,
sounds. Colours and combination of colours
play an important role in distinguishing
goods on the market, being extremely useful
in cases when the traditional trademarks are
not easily perceptible. The main purpose of
the work is argumentation of the need for
registration of colours per se and combinations
of colours as trademarks or companies
are seeking for new possibilities of highlighting
goods not only by words and figurative
signs but also by certain colours perceived,
incontestably, more easily by the consumers
than other trademarks. The excessive offer of
counterfeit goods undermines confidence in
the known trademarks, decreasing the volume
of home and foreign investments, since the
capital is invested there where protection of
intellectual property is much more confident.
Protection of trademarks of such type needs
special provisions in the law. Refusal of
applications for the registration of trademarks
- colours per se and combinations of
colours, involves infringement of the producer’s
rights and, what is not less important,
of the consumer’s rights. As researches state,
the large companies, acting in the region,
consider that enforcement of an effective
protection in the field of intellectual property
needs close cooperation between the private
sector and the state authorities. |
