Rezumat

P rotection of three-dimensional forms may be afforded by patent for invention (utility model), registration as industrial designs, copyright and as trademarks. Since the protection of trademarks is not limited in time, provided the renewal, there exist the tendency of protecting three-dimensional forms as trademarks. In order to avoid protection by means of marks of the three-dimensional forms, constituting the subject-matter of an invention or of copyright, most legislations have excluded from protection by marks the three-dimensional forms, which are necessary for obtaining a technical result and those referring to the essential value of the products. The three-dimensional forms may be registered as industrial designs and trademarks if they meet the conditions provided by both modalities of protection. The main difference between them is that the trademark contributes to the consumer protection from the risk of confusion as to the origin of goods and services, while the industrial design protects only the exclusive right of the owner to manufacture the product without taking into account the indication of origin. There are two different in principle types of three-dimensional marks: n three-dimensional forms as such, representing the external shape of the product or package, and n three-dimensional forms as such, not referring to the shape of the product or package and which may be composed of different elements: letters, numerals, words, etc. and of figurative elements: figures, relieves, geometrical forms, etc.
