Rezumat

This article is dedicated to the disclosure of the essence of legal discrimination norms
applied by the totalitarian governance regimes towards our countrymen both in Bessarabia and
outside it. Highlighting the discrimination aspects in the Soviet legislation that includes the description
of some concrete cases of flagrant violation of fundamental human rights concerning
Romanian descendants, we reach to the conclusion that neither contemporary legislation of the
Republic of Moldova, nor high members of state structures have not completely disembarrassed
from the Soviet doctrine influence. This fact generates social and political instability in the Republic
of Moldova, maintaining separatist guidelines and constituting an obstacle to EU integration.
On this basis the author highlights the need to continue the reform of the Moldova’s
legislation to ensure the human rights and freedoms, to establish a democratic state, including
the elimination from the state structures the people with a doubtful past and with a Bolshevik
mentality. The adoption of a lustration law among other legal norms would be a path to an
efficient achievement of these objectives.
