It is done in the present article a scientific analysis of the fundamental guarantees in the business activity. The most important seems to be the reflection of the question of constitutional guarantee of the property of the businessmen. The accent falls on the principal notion of the reinforcement of the active role of the state and the influence of the law on the economy in the period of the transition from one economic system to another. There are suggested steps directed to the propaganda of the business in the frames of the state regulation of the private law area of social relations.
