There is a multitude of causes that determine increasingly serious difficulties that justice has to face, everywhere in the world, and that substantially diminish its efficiency. Thus, it is not by chance that people talk more and more frequently of a real “justice crisis”. At the same time, social conflicts grow and diversify, exceeding by far the actual ability of the legal system to manage them. Thus, alternative dispute settlement ways are absolutely necessary. Such alternatives have become to take shape in the legal system of our country as well, both by the seizing of the opportunity by Romanian law makers, as well as further to the recommendations of the bodies of the European Union. We refer here to the conflict mediation procedure regulated by the law 192/2006 on the mediation and organization of the mediator profession.
