В статье исследованы перспективы создания муниципальных органов охраны правопорядка. Определены состояние изучения муниципальных правоохранительных органов в отечественной и зарубежной правовой науке, определены предпосылки формирования и становления отечественных муниципальных правоохранительных институтов в качестве исполнительных органов местного самоуправления. Проведен анализ развития и становления органов местного полицирования в современной Украине, уровень законотворческой деятельности в этом направлении. Исследовано существующую практику органов местного самоуправления в Украине по созданию муниципальных институтов охраны правопорядка. Выяснено, распространенные формы решения правоохранительных задач органами местного самоуправления. Сделан вывод, что образование муниципальных органов охраны правопорядка требует решения целого комплекса теоретико-правовых и организационно-правовых проблем.

The article deals with the prospects for the creation of municipal policing bodies. The study of municipal lawenforcement bodies in the domestic and foreign legal sciences has been analyzed. Th ere has been determined the preconditions for formation of domestic municipal policing structures as executive bodies of local self-government. Th e development and formation of local police in modern Ukraine has been analyzed along with the lawmaking level in this fi eld. The existing practice of Ukrainian municipalities of creation of local policing agencies has been researched. The most common forms of solution of law enforcement tasks by local self-government bodies have been elucidated: structural units of executive bodies of local self-government; communal institutions not included in the system of executive bodies of local councils; communal companies with security functions; involvement of civil society organizations to the permanent law enforcement activities; involvement of the National Police on a contractual basis. It has been concluded that the formation of municipal law enforcement agencies requires the solution of a range of theoretical, legal and organizational problems: a comprehensive scientifi c analysis of the legal status of municipal policing agencies, the formation of the legal foundations for their organization, the development of a mechanism for the transition to decentralized policing forms; adoption of a law defi ning the organizational framework and the procedure for the municipal law enforcement agencies; development of the concept for a comprehensive solution of legal, organizational, fi nancial and other issues related to the transfer of some police functions to municipalities.

Articolul studiază perspectivele de creare a poliției comunitare. A fost cercetat stadiul de dezvoltare a realizării mecanismului de asigurare a ordinii de drept în știința juridică autohtonă și internațională; au fost identifi cate premisele pentru formarea poliției comunitare în calitate de organe executive ale autoguvernării locale. Analiza de dezvoltare și formare a poliției comunitare în Ucraina modernă, nivelul de activitate legislativă în această direcție. A fost cercetată practica existentă a administrațiilor publice locale din Ucraina de a crea organe de poliție comunitară. Au fost constatate cele mai reușite forme de soluționare a provocărilor locale de poliția comunitară. În concluzie, rezidă că formarea poliției comunitare necesită soluționarea unui întreg complex de probleme teoretice, juridice și organizaționale.
