There exist more principal criteria related to the elaboration of the trademark: the trademark shall
be easy and well memorable, contain a message on the company, on the product etc. But rstly,
it shall be original for carrying out its basic function: to characterize one product from another.
In Moldova there are many cases where the applicants disregard such requirement, ling for
registration signs with a reduced originality level. The phenomenon is completely negative;
the originality of the sign protected as a mark being compromised from the moment where the concurrent
assumes a foreign idea and thus, steals the existent mark. As a result, it appears the situation
of confusion, where any of signs of the mark does not possess a high level of the distinction. |
