Orice domeniu de activitate se dezvoltă, unele mai repede decât ne-am dori, prin urmare și normele legale care reglementează relaţiile sociale se modifi că. În anul 2010 a fost adoptată Legea nr.139 privind dreptul de autor și drepturile conexe, care reglementează raporturile ce apar la crearea şi valorifi carea diferitor categorii de opere, interpretări, fonograme sau alte obiecte ce rezultă din activitatea creativă din domeniul literar, artistic su știinţifi c. Pe parcursul celor zece ani de aplicabilitate a prevederilor din Legea nr.139/2010 au fost identifi cate mai multe norme defectuoase care necesită a fi modifi cate, în special a celor ce ţin de gestiunea colectivă a drepturilor. De asemenea, necesitatea de armonizare a cadrului legislativ naţional cu aquis-ul comunitar au creat premise de a iniţia procesul de modifi care și de completare inclusiv a Legii nr.139/2010. Constatăm că, deși au fost mai multe tentative, până în prezent procesul se desfășoară destul de anevoios, deoarece încă nu au putut fi găsite soluţii care să mulţumească toate părţile.

Any fi eld of activity is developing, some faster than we would like, therefore the legal rules governing social relations are also changing. In 2010, Law No. 139 on Copyright and Related Rights was adopted, which regulates the relationships that appear when creating and using diff erent categories of works, performances, phonograms or other objects resulting from creative activity in the literary, artistic and scientifi c fi eld. During the ten years of applicability of the provisions of Law No. 139/2010, several defective norms have been identifi ed that need to be modifi ed, especially those related to the collective management of rights. Also, the need to harmonize the national legislative framework with the acquis communautaire has created premises to initiate the process of amending and supplementing including Law No. 139/2010. It should be stated that, although there have been several attempts, so far the process is quite diffi cult, because no solutions have yet been found to satisfy all parties.
