Rezumat

The principle of preeminence of law is inherent to the spirit of the Constitution of the Republic of Moldova and represents its core, thus the Constitutional Court of the Republic of Moldova has the mission to ensure legal security through mechanisms of constitutional jurisdiction. The author considers that the Ministry of Education, as well as the Ministry of Economy, does not possess the necessary capacity and experience to take over from the Academy of Sciences of Moldova the functions of drafting and promotion of the policy on researchdevelopment and innovation, delegated by the Code on science and innovation. Thus, taking into account the state of the Republic of Moldova, it is optimal to establish an autonomous public entity with the status of a central administrative authority that will realize the state policy on research-development, innovation and technology transfer – a function that is not in the competence of ministries. The author comes up with arguments confirming that the principles in question are still not complied with both in the drafting of legislative acts within the Government, the State Chancellery, the ministries and other central administrative authorities, and in the process of their adoption by the Parliament. Implementation of the Code on science and innovation, amended by Law no. 190 of 21.07.2017 and republished, without additional amendment, will have disastrous consequences on the scientific community and the performance of the research and development field, including the Academy of Sciences of Moldova and the research and development institutions, their image in the European and International research area. The author analyzes and brings arguments that confirm the non-observance of the criteria of the quality of the norms of law in the process of adopting the definitions of the main notions of the Code of Science and Innovation of the Republic of Moldova no. 259 of 15.07.2004 (republished), including in comparison with the legislation, good practices and doctrine of the European and International Research Area.
