The offense is the act of conduct prohibited by the incriminating rule, act committed by a natural person, thereby violating its obligation not to commit it, against the social value of which the person is the holder. Those individuals who are involved in the criminal legal conflict report – are called crime subjects. The actuality of the topic investigated in this work is determined by the fact that the subject of the offense is an important criminal law institution, which includes both the person who committed the offense (the active subject) and the person to whom his rights have been violated (the passive subject). |
