Personalitatea infractorului este un subiect controversat și puțin studiat în științele sociale și umaniste. În drept de cele mai dese ori se aplică teoriile clasice care descriu personalitatea infractorului din perspectiva complexității faptei care a săvârșit-o și nu din cea a împrejurărilor (mediului social) în care individul s-a dezvoltat ca personalitate. Criminalistica studiază personalitatea infractorului din perspectiva structurii și trăsăturilor principale a comportamentului și acțiunilor săvârșite și explică impactul factorilor biologici din perspectiva dinamicii incluziunii în mediul social. În teoriile actuale se pune accent pe clasificarea infractorilor după tipul de personalitate, inteligența, nivelul de studii, competența profesională, dar și pe asigurarea bunăstării deținutului prin tehnici de yoga și meditație.

The personality of the offender is a controversial subject and little studied in the social sciences and humanities. The most often applied in law are the classical theories that describe the personality of the offender from the perspective of the complexity of the act that committed it and not from the circumstances (social environment) in which the individual developed as a personality. Forensics studies the personality of the offender from the perspective of the structure and main features of the behavior and actions committed and explains the impact of biological factors from the perspective of the dynamics of inclusion in the social environment. Current theories focus on classifying criminals by personality type, intelligence, level of education, professional competence, but also on ensuring the well-being of the detainee through yoga and meditation techniques.
