Rezumat

In the current situation, marked by the crisis caused by the COVID-19 virus worldwide, when certain human rights have been limited and sometimes even violated, at the level of all states where the state of emergency was established, a research dedicated to the concept of "Public interest", in terms of legislation in Moldova compared to Romania, is a current issue. The importance of the correct understanding of the notion / concept of public interest lies in the fact that the public interest serves as one of the main arguments / justifications for issuing decisions by some public authorities meant to influence in some cases the whole society. The purpose of this article is to identify the legal framework in which the concept of public interest is used, and in what context the legislator from the Republic of Moldova and Romania operates with the notion of public interest. The legislator from the Republic of Moldova, unlike the one from Romania, does not explicitly define in the text of the law what information of public interest represents, and this can generate certain extensive interpretations, sometimes even abusive ones. The public interest serves as one of the main arguments when it comes to issuing decisions by some public authorities in order to regulate certain crisis situations or more complicated as was the case with the establishment of the state of emergency caused by the COVID-19 virus.
