Стаття присвячена аналізу доктринальних джерел і нормативно-правових актів України та ЄС у сфері охорони атмосферного повітря від забруднюючих речовин. Акцентовано увагу на низці суперечливих аспектів у підходах і стандартах здійснення охорони атмосферного повітря країнами Європейського Союзу та Україною, а також відсутності ефективних механізмів регулювання охорони та захисту атмосферного повітря, які забезпечували б прогнозовану якість атмосферного повітря та дотримання природоохоронних стандартів. Визначено основні дефекти та інші недоліки української нормативно-правової бази, які потребують конструктивного удосконалення і адаптації до законодавства Європейського Союзу.

The article is devoted to the analysis of doctrinal sources and normative legal acts of Ukraine and the EU in the field of protection of atmospheric air from pollutants. Emphasis is placed on a number of contradictory aspects in the approaches and standards of air protection by the European Union and Ukraine, as well as the lack of effective mechanisms for regulating air protection and protection that would ensure predictable air quality and compliance with environmental standards. The main defects and other shortcomings of the Ukrainian legal framework, which need to be constructively improved and adapted to the legislation of the European Union, have been identified.

Articolul este dedicat analizei surselor și reglementărilor doctrinare ale Ucrainei și UE în domeniul protecției aerului atmosferic împotriva poluanților. Se subliniază o serie de aspecte contradictorii în abordările și standardele de protecție a aerului de către Uniunea Europeană și Ucraina, precum și lipsa unor mecanisme eficiente de reglementare a protecției aerului care ar asigura calitatea previzibilă a aerului și respectarea standardelor de mediu. Au fost identificate principalele defecte și alte deficiențe ale cadrului legal ucrainean care trebuie îmbunătățite constructiv și adaptate la legislația Uniunii Europene.
