The present work is devoted to practical problems and theoretical discrepancies in the application of the estimate sign “considerable damage”. There are analyzed the legislator formulations and the law enforcement practice. Our point of view is that exactly the prosecution is responsible for improper ap- plication of the indicated sign, because in Republic of Moldova public prosecutors have to establish all the qualifying elements on the stage of prosecution and to prove them in court. On the basis of illustrative examples and theoretical inventions there are presented a number of con- clusions, followed by appropriate proposals to eliminate detected errors. Implementation of proposals, namely the adoption of corresponding instructions by Prosecutor General’s Office and some additions in the Criminal Code, will provide better observance of a principle of legality.
