In the present paper we examine the problem concerning the participation of the lawyer in the real-
ization of some acts of penal prosecution. Examples are given of instructions, of articles from the Penal
Code of Romania, concerning the defense of the accused or defendant. Process actions to which the
participation of the lawyer is necessary cannot be considered as fulfilled with the infringements of the
penal procedures norms.
The participation of the lawyer in the process activity of hearing of the defendant during the penal
prosecution – not to admit degrading procedures in obtaining information, confessions from the accused
or defendant, which would infringe the human dignity.
