Although through the content of the 189th article of the Penal Code of Republic of Moldova we can
deduce the presence of a special purpose of extortion - to the cupidity of the offence, with examples of
legal practice, that make integral part of the present study, we can argue that the appliance of the
an
norm has interpretations far from uniform. This situation cannot have a positive influence on the correct
qualification of the crime, and consequently on the quality of justice. Therefore, through our investiga-
tion, we stated for an explicit model of the signs that characterize the subjective element of the offence,
bringing the necessary arguments to substantiate our doctrinal position.
