In this article, it is shown that in the Romanian penal law, we note a reconsideration of the concept
on the general juridical object of the offense of trespassing: in the Romanian Penal Code from 1968, the
offence in question is part of the offences against person’s freedom; in the Romanian penal code of 2009,
the offence of trespassing is considered part of the group of offences that involves the place of abode and
private life. In the context of the Penal Code of Republic of Moldova, the general juridical object of the
offence provided by art.179 PC RM has a different content: the social relations on the achievement of
political rights, labor and other constitutional rights of the citizens.
