This article relates to the protection of industrial property rights, especially industrial intellectual creations. This article is a judicial analysis of the criminal law in the industrial property protection field, which highlights the characteristic features of the trade secret, objects which can be protected by trade secret, the difference between trade secret and patent for invention. There was also analyzed the current regu- lation of trade secret in the legislation of Republic of Moldova in relation to international agreements to which Republic of Moldova is party (TRIPS Agreement). At the same time, in the given article there are mentioned the gaps in the protection of industrial property rights in Republic of Moldova and some proposals to improve the legislative framework for the protection of industrial property rights in our country are presented. Theer is also proposed a juridical analysis of the criminal act concerning the trade secret, analyzing the subject, the objective side of the offence in question.
