This article is devoted to issues of comparative law of regulating the liability for the offence of tres-
passing. In this plan there are analyzed the corresponding settlements in the penal laws of Poland, Swit-
zerland, Argentina, Netherlands, Germany and Norway. Thus, the groups of foreign laws are subject to
investigation, where the act of trespassing is stipulated in the frame of penal law departments dedicated
to offences against freedom or public order. As a result, conclusions are drawn, which may be useful in
improving the penal law of Republic of Moldova and Romania.
