In this article we enabled a research polemic regarding blackmail that involves the kidnapping of the owner or holder of a good, his relatives or their relatives, the offense itself integrated in the list of its aggravating circumstances, issues provided by the 4th part of the 189th article of the Penal Code of Moldova. Thus, our scientific approach aimed the objective of solving the contradictions between mutual penal norms, analyzed in the context of the legal qualification of the offence set out by 4th part of the 189th article, the 164th article, 164th article index 1 and the 166th article of the Penal Code of Moldova. Through our work similarities and differences were identified between the 4th part of the 189th article of the Penal Code and kidnapping committed for profit interests (letter f of the 2nd part of the 164th of the Penal Code). Also, some solutions given in the article were recovered from the judicial practice, involving the aim to revel the negligence of specific state authorities regarding the actions of implementing demarcation lines between the 4th part of the 189th article and the f) letter of the 2nd part of the 164th of the Penal Code.
