In the present study, are shown the differences of the technical-legislative approach regarding the incriminations framework devoted to penal defense of industrial property: in Romania, the liability for offences in the industrial property sphere is established in the context of extrapenal laws that contain incrimination dispositions; in the Republic of Moldova, the liability for such offences is provided by art.1852 and 1853 PC RM. It is also shown that, unlike the criminal law of the Republic of Moldova, the Romanian legislation does not incriminate distinctly the inciting of the third party to achieve the trespassing the right on the object of industrial property. It is revealed that, unlike the criminal law of the Republic of Moldova, the Romanian legislation does not provide the binding of causing material damages by trespassing the right on the object of industrial property. It is concluded that, unlike the Romanian legislation, the Republic of Moldova legislation does not contain detailed regulations concerning each of the segments of industrial property protected penally. |
