The article is devoted to the urgent problem of determining the existence of the principle of international law on the basis of four main criteria, namely normality, as a criterion of the legal nature of a special rule-the principle of international law; ordinary, as a criterion of origin principle; universality, as a criterion of the legal force of the principle of international law; fundamentality, as a system-forming criterion. The problem of the dependence of the availability of criteria for the determination of the principle of international law from various sources in which the principles find their reflection is investigated. The tendency of convergence of the fundamental principles of international law and the constitutional principles of internal law within the framework of the contemporary problem of the existence of international constitutive (constitutional) law is analyzed. Статья посвящена актуальной проблеме определения наличия принципа международного права на основании четырех основных критериев, а именно нормативность, как критерий правовой природы особой нормы-принципа международного права; обычность, как критерий происхождения принципу; общеобязательность, как критерий юридической силы принципа международного права; основоположность, как системообразующий критерий. Исследуется проблема зависимости наличия критериев определения принципа международного права от различных источников, в которых принципы находять свое отображение. Анализируется тенденция сближения основопологающих принципов международного права и конституционных принципов внутреннего права в рамках современной проблемы существования международного конститутивного (конституционного) права.
