У статті наводяться наукові погляди на проблемні питання методології юридичної науки, визначення та застосування методологічних підходів та методів наукового пізнання у процесі дослідження адміністративно-правового забезпечення охорони права інтелектуальної власності. Здійснюється аналіз юридичної літератури, звертається увага, що виконання наукового дослідження вимагає наявності як теоретичних, так і методологічних підходів до об’єкта дослідження, які необхідні для роботи на теоретичному та емпіричному рівнях. Дослідження адміністративно-правового забезпечення охорони права інтелектуальної власності потребує наукового осмислення, яке не можливе без здійснення аналізу методологічної основи дослідження. З цією метою проаналізовано загальнофілософські, загальнонаукові та спеціальні методи пізнання правових явищ, усі ці методи разом допомогли оцінити сучасний стан об’єкта дослідження

The article presents scientific views on the problem issues of the methodology of legal science, the definition and application of methodological approaches and methods of scientific knowledge in the process of research of the legal and administrative support for the protection of intellectual property rights. An analysis of legal literature is being carried out, attention is drawn to the fact that the implementation of scientific research requires the availability of both theoretical and methodological approaches to the research object that are necessary for work at the theoretical and empirical levels. Investigation of the administrative and legal provision of the protection of intellectual property rights requires scientific reflection, which is not possible without an analysis of the methodological basis of the study. For this purpose general philosophical, general scientific and special methods of knowledge of legal phenomena are analyzed, all these methods together helped to assess the current state of the object of research.
