Rezumat

Knowing the legal nature of notarial acts becomes extremely important and fully justified in the context of a society that bears the mark of transformations. The lack of a clear legal definition of the phrase „notarial act” and the complex structure of the notarial procedure have generated contradictory discussions in the legal doctrine regarding the legal nature of the notarial act. In this context, the legal nature of notarial acts will be dealt with by the views that have been exposed in the field of notarial law in Romania, the Republic of Moldova, France, the Russian Federation and Ukraine. In this study we came to the conclusion that the notarial act has a special legal character, since the notary is a special institution in the hierarchy of legal institutions and operates within the boundaries of private and public law. The legal nature of the notary has a dichotomy: the notary acts on the one hand by the name of the state, exercising the function of public power, and on the other hand, he is an impartial and independent professional. Based on the fact that a notary can not enjoy absolute freedom in the conduct of his activities, it can be concluded that his notarial acts are not strictly private legal in nature, since they are influenced by public authorities.

Cunoașterea naturii juridice a actelor notariale devine extrem de importantă şi pe deplin justificată în contextul unei societăți ce poartă amprenta transformărilor. Lipsa unei definiții legale clare în privința sintagmei „act notarial”, precum și structura complexă a procedurii notariale, au generat discuții contradictorii în doctrina juridică privitor la natura juridică a actului notarial. În acest context, abordarea naturii juridice a actelor notariale o vom efectua conducându-ne de opiniile care au fost expuse în materia dreptului notarial din România, Republica Moldova, Franța, Federația Rusă și Ucraina. În cercetarea efectuată am ajuns la concluzia că actul notarial manifestă o natură juridică aparte, deoarece notariatul se distinge ca o instituție specifică în ierarhia instituțiilor de drept și funcționează la limita dreptului privat și public. Natura juridică a notariatului prezintă dihotomie: notarul acționează, pe de o parte, din numele statului, exercitând funcția de putere publică, iar pe de altă parte, este un profesionist imparțial și independent. În temeiul faptului că notarul nu se poate bucura de o libertate absolută în exercitarea profesiei sale, deducem că nici actele notariale ale acestuia nu pot avea o natură juridică pur privată, fiindcă sunt influențate și condiționate de amprenta autorității publice.

Знание правовой природы нотариальных актов становится чрезвычайно важным и полностью оправданным в контексте трансформации общества. Отсутствие четкого законодательного определения понятия «нотариальный акт», а также сложная структура нотариальной процедуры, вызвали противоречивые дискуссии в правовой доктрине относительно юридического характера нотариального акта. В этом контексте юридический характер нотариальных действий будет рассматриваться, исходя из мнений, которые были выявлены в области нотариального права Румынии, Республики Молдова, Франции, Российской Федерации и Украины. В данном исследовании мы пришли к выводу, что нотариальный акт имеет особый правовой характер, поскольку нотариус является особым институтом в иерархии правовых институтов и действует в границах частного и публичного права. Правовой характер нотариата представляет собой дихотомию: нотариус действует, с одной стороны, от имени государства, исполняя задачи публичной власти, а с другой - является беспристрастным и независимым профессионалом. На основании того, что нотариус не может пользоваться абсолютной свободой при осуществлении своей деятельности, можно заключить, что его нотариальные действия не носят исключительно частный правовой характер, поскольку на них оказывают влияние органы публичной власти.
