Rezumat

Статья посвящена анализу практики членов Международного суда ООН, являвшихся гражданами Советского государства. Изучив научную и практическую деятельность юристов-международников советской школы, автор утверждает, что они были заложниками коммунистической идеологии и «направляющей» политики партийного руководства СССР, поэтому, в частности, роль Международного суда ООН и значение его решений характеризовались адекватно идеологическим установкам. Автор доказывает, что советская наука международного права признавала назначение Международного суда ООН в рассмотрении юридических споров между государствами, а «присвоение Суду иных функций ведет к подрыву его авторитета»; в своей деятельности Суд должен исходить из основных принципов международного права, при этом он не может иметь правотворческих функций, и, следовательно, не создает судебных прецедентов.

The article is devoted to the analysis of the practice of members of the International Court of Justice, who were citizens of the Soviet state. Having studied the scientific and practical activities of lawyers of the Soviet school of international law, the author claims that they were hostages of the communist ideology and the «guiding» policy of the leadership of the USSR, therefore, in particular, the role of the International Court of Justice and the significance of its decisions were characterized by ideological attitudes. The author argues that Soviet science of international law recognized the Court’s role is to settle, in accordance with international law, legal disputes submitted to it by States and to give advisory opinions on legal questions referred to it by authorized United Nations organs and specialized agencies; «the assignment of other functions to the Court leads to the erosion of its authority», so it can’t have lawmaking functions, and, therefore, does not create judicial precedents.
