Rezumat

The legal sanctions regulated by contemporaneous legislations are more upgraded from various perspectives in comparison with the first ones known by the humankind, first of all, from the rigidity perspective. The severity and harshness of sanctions of those times were viewed as normal, since the punishment, no matter how inhuman it was, expressed the will of divinities, will that could not be opposed or judged by anyone. In what concerns the harshness of the punishment, in Ancient Times there was used “The Retribution Law”, which equals: “An eye for an eye, a tooth for a tooth”. All ancient peoples applied with insignificant differences this law. According to the Retribution Law - a homicide was punished with a homicide, thus the capital punishment.
