У статті на підставі узагальнення зарубіжного досвіду функціонування системи органів юстиції встановлюється факт досить поширеної практики організаційного зв’язку юстиції та служби виконання покарань, а також виявлено, про що свідчить більшість зарубіжних практик, існування окремих структурних підрозділів, які займаються безпосереднім управлінням пенітенціарною сферою. Також у ході дослідження з’ясовано, що пряме управління з боку Міністерства юстиції для світових практик не характерне.  У статті порушуються питання безпосередньої відповідальності Міністерства юстиції України за напрямок виконання кримінальних покарань, систему установ тримання осіб під вартою та пробації. Звертається увага на необхідність проведення детального аналізу системи управління пенітенціарним напрямком у системі юстиції

In the article, on the basis of generalization of foreign experience of the system of justice bodies functioning, the fact of rather common practice of organizational connection of Justice and Penal Service is established. It is also revealed, as the majority of foreign practices shows, the existence of separate structural units that directly govern the Penitentiary sphere. Also, the study found out, that direct governing by the Ministry of Justice is not typical for world practice.  The issues of direct responsibility of the Ministry of Justice of Ukraine for the direction of execution of criminal punishments, the system of institutions for persons’ detention and Probation are raised in the article. Attention is drawn to the need for a detailed analysis of the system of penitentiary direction governing in the Justice System..  

În articol, pe baza de generalizare a experienței străine de funcționare a faptului organismelor din sistemul de justiție se stabilește practică destul de comună de comunicare organizațională de Justiție și Serviciul Penitenciar, și a constatat, după cum reiese din majoritatea practicilor străine, existența unor departamente separate, sunt angajate în controlul direct al sistemului penitenciar. De asemenea, în timpul studiului sa constatat că managementul direct al Ministerului Justiției pentru practicile mondiale nu este tipic.  Articolul se referă la aspectele de responsabilitate directă a Ministerului de Justiție al Ucrainei cu privire la direcția de executare a sancțiunilor penale, a sistemului de detenție și a probațiunii. Se atrage atenția asupra necesității unei analize detaliate a sistemului de management al sistemului penitenciar în sistemul judiciar.
