В статье проводится исследование сущности банковской тайны и ее места в финансово-правовых отношениях, а также влияние надлежащего правового обеспечения на уровень благосостояния всех членов украинского общества. Правовое регулирование финансово-правовых отношений в сфере банковской тайны еще недостаточно изучено в юридической литературе, так как в современной правовой доктрине отсутствует единый взвешенный подход к формулировке и толкованию данного понятия. Обосновывается, что законодательство может и должно защищать право на ту информацию, которая обладает признаками банковской, коммерческой и другой тайны. И если вопросы, связанные с охраной государственной тайны, детально урегулированы, то вопросы, связанные с защитой сведений, составляющих банковскую тайну, относятся к числу менее разработанных в правовой литературе. На сегодняшний день отдельные нормы, регулирующие вопросы, связанные с содержанием и порядком предоставления сведений, составляющих банковскую тайну, содержатся в различных нормативных актах. А специальный закон об охране банковской тайны отсутствует.

The article deals with the essence of bank secrecy and its place in financial and legal relations, as well as with the impact of proper legal support on ensuring the welfare of all members of Ukrainian society. Legal regulation of financial and legal relations in the sphere of bank secrecy has not been sufficiently studied in the legal literature, as there is no single weighted approach to the formulation and interpretation of this concept in modern legal doctrine.It is substantiated that, the legislation can and should protect the right to the information that has signs of banking, commercial and other secrets. If issues related to the protection of state secrets are regulated in details, then issues related to the protection of information constituting bank secrecy are among the less developed in the legal literature. At the moment separate provisions governing issues related to the content and procedure of the provision of information that constitute bank secrecy are contained in various regulatory acts. Meanwhile there is no special law on bank secrecy protection.
