Rezumat | |||||||
The judicial space determines the limits within which the action of the law extends in relation to a certain territory. Being the expression of the state’s sovereignty, which proclaimed it, the law limits, adapts its judicial effects within the territory of the state. The law, and, the legal rules, especially, is the characteristic of is the coordinate of the spatiality, as there cannot be and there is not a universal legislator of all states. The judicial space is characterized by certain attributes as: 1) exclusive or sovereign public power (sovereignty) on the entire territory of the state; 2) state structure; 3) integrity, homogeneity, continuity; 4) its territorial limits; 5) its systemic nature; 6) inner unity; 7) external unity. The mentioned attributes characterize the essence of the judicial space, regardless the form and the regime of the government, state organization form and political regime of the state. |
