The theoretical research of the essence of the witness’s testimony in the civil legal proceedings is conducted in the article. The subject matter of the witness’s testimony is discovered through the analysis of the common and specific features of the given means of proving. The author systematizes the specific features by the structural elements of the witness statements in the civil procedure. The specific features of recording the sources of the witness statements, i.e. the features of the witness who is at the same time the participant of the civil procedure are highlighted in the article. The specific features of the content of the witness’s testimony in the civil procedure are defined and analyzed by the author. The material of the article is written in the comparative and legal aspect based not only on the Ukrainian but also foreign countries civil procedure legislation.

В статье проводится теоретическое исследование сущности показаний свидетеля в гражданском судопроизводстве. Сущность показаний свидетеля раскрывается через анализ общих и специальных признаков данного средства доказывания. Специальные признаки автором систематизируются, исходя из структурных элементов показаний свидетеля в гражданском процессе. Выделяются специальные признаки источника фиксирования показаний свидетеля: признаки свидетеля, который является одновременно участником гражданского процесса. Выделяются и анализируются специальные признаки содержания показания свидетелей в гражданском процессе. Материал статьи написан в сравнительно-правовом аспекте, где берется во внимание гражданское процессуальное законодательство не только Украины, но и других стран.
