Rezumat

Terminology has always existed because each area of science has its own terminology. However, as a scientific discipline, it appeared quite recently. The terminology describing the specific terms of one or several spheres of knowledge has a multidisciplinary character. There is a fundamental distinction in the definition of terminology. The main purpose of this article is to describe the characteristics of legal terms (type, conceptual field, notional category) and to identify their specific use in lawyers’ speeches. This article examines the theoretical basis of the concept of terminology in linguistics, finds such notions as the term, concept, context; reveals the characteristics of terms to base the practical analysis that is made at the base of two judicial discourses of France (Erard (XVIIs.) and Moro-Giafferri (XXs.)). During this analysis the author examines not only the taxonomy of legal terms but the conceptual classes that encompass ten conceptual categories; compares these characteristics of the term in two defensive discourses of different epochs of France and shows that the legal terminology system is stable, understandable and suitable for general public.
