Rezumat | ||||||
Penal law constituting a big variety always has been different according to their importance. Obvious, the notion of significance (gravity) varies from nation to nation, from century to century and depending on the regime that has the political power in a specific period of time. It is of no doubt that penal laws had always established different repression regimes, according to the sternness of the committed actions. We consider that in any case, the difference should be found in the social danger. That is why we will define minor offence as an action committed by guiltiness, considered by law, at a certain level that it represents an antisocial deed, of minor danger that although has to be punished. Judicial literature is unanimous that minor offence attempt has not to be punished and the guiltiness is presumptive up to the opposite proof (evidence). |
