One of the most important civil rights is the right to liberty and security of person. According to Article 5 of the
European Convention for the Protection of Human Rights and Fundamental Freedoms of 1950 and Article 9 of the 1966 International Covenant on Civil and Political Rights, “Everyone has the right to liberty and security of person”. The right consists of two components. The first component of the right to freedom can be defined as the right to have a person on your own. The right to liberty and security of person is understood in the legal literature, as in the narrow and broad sense. In a broad sense, the right to liberty and security of person, along with the physical freedom also includes the spiritual and mental
freedom and integrity. The second component of the right to security of the person includes the inadmissibility of intervention in the area of personal freedom, both from government and from third parties. |
