Initially, the Moldovan legislature recognized the repeating of the offence as type of the offences plurality.
Committing a number of offences by a person is considered plurality of offences, provided that at least for two of them, there are no procedural obstacles for starting a new criminal lawsuit and that the person in question has not been convicted
for any of them. However, with the entry into force on June 13, 2003, of Law no.211/May 29, 2003, the situation changed: paragraph (1), article 32 Criminal Code of the Republic
of Moldova was repealed, remaining in force the provision from the former paragraph (2) (which became sole paragraph) of article 32, Criminal Code of the Republic of Moldova: “Plurality of crimes represents, as appropriate, multitude
of crimes or recidivism”. Most Moldovan authors, at the delimitation of the offence prolonged by the repeated offence are guided by the subjectivity of these two legal entities, issues to be analyzed in this paper. |
