Articolul conține un studiu științific în domeniul poziției de asigurare a drepturilor și libertăților fundamentale garantate constituțional, care sunt esențiale pentru libera dezvoltare a personalității umane în cadrul societății, iar asigurarea lor reală cu drepturi garantate constituie fundamentul societății. În prezentul articol vom elucida atât legătura organică dintre dreptul garantat și dreptul asigurat, adică unitatea complexă a fenomenului, cât și plenitudinea reglementărilor normative, prin prisma abordărilor doctrinei în literatura de specialitate. În conceptul actual al practicii comunității umane contemporane, statul de drept și democratic prin prisma autenticității, este acela în care demnitatea omului, drepturile și libertățile lui, libera dezvoltare a personalității umane reprezintă valori supreme și sunt garantate prin art. 1 alin (3) din Constituția Republicii Moldova.

The article contains a scientific study in the field of the position of ensuring the constitutionally guaranteed fundamental rights and freedoms, which are essential for the free development of the human personality within the society organized in the state. And their real insurance with guaranteed rights constitutes the foundation of the society, which in fact is absent. In the given article we will elucidate both the organic connection between the guaranteed right and the insured right, that is, the complex unity of the phenomenon as well as the fullness of the normative regulations, through the prism of approaches to the doctrine in the specialized literature. Annotation It should be included that in the current concept and practice of the contemporary human community, the rule of law and democracy through the prism of authenticity, is the one in which the dignity of man, his rights and freedoms, the free development of the human personality represent supreme values and are guaranteed by art. 1 paragraph (3) of the Constitution of the Republic of Moldova

L’article contient une étude scientifique dans le domaine de la position de garantir les droits et libertés fondamentaux constitutionnellement garantis, qui sont essentiels au libre développement de la personnalité humaine au sein de la société, et leur garantie réelle avec des droits garantis constitue le fondement de la société. Dans cet article, nous éluciderons à la fois le lien organique entre le droit garanti et le droit assuré, c’est-à-dire l’unité complexe du phénomène, et la plénitude des réglementations normatives, à travers le prisme des approches doctrinales de la littérature spécialisée. Dans le concept actuel de la pratique de la communauté humaine contemporaine, l’état de droit et la démocratie à travers le prisme de l’authenticité, est celui dans lequel la dignité de l’homme, ses droits et libertés, le libre développement de la personnalité humaine représentent des valeurs suprêmes et sont garantis par l’article 1 paragraphe (3) de la Constitution de la République de Moldova.

Статья содержит научное исследование в области обеспечения конституционных гарантий основных прав и свобод человека, которые нужны для свободного развития личности в обществе, организованном государством. Фактическое обеспечение конституционных гарантий прав человека является основой общества, которого на самом деле нет. В данной статье определяется отличие в органической связи гарантированных прав от обеспеченных прав, то есть, как сложное единство явления, так и полноту нормативного регулирования, сквозь призму научных подходов к специализированной сфере и соответствующей литературы. Следует отметить, что в современной концепции и практике современного гражданского сообщества, область верховенства права и демократии рассматривается сквозь призму аутентичности – это то, в чем состоит достоинство человека, его права и свободы, свободное развитие личности, что представляет собой высшую ценность и гарантируется ст. 1 часть (3) Конституции Республики Молдова.
