The concept of guilt and its problems in the historical context have been the subject of discussions in theological, philosophical, psychological, psychoanalysis, in culturology research and jurisprudence for a long period of time. The guilt is attributed primarily to the human being, free in spirit and act, so he or she can be guilty of talking, deed or/ and thought. Man has guilty thoughts incompatible with the values he knows, but he does not want to live with them; he has guilty words spoken in other people's addressability; he has guilty acts - committed by actions or inactions, equally incompatible with the values which he knows, but which he does not want and does not live. Apart from the fact that any knowledge is objectively incompatible and subjectively one-sided, we can have an erroneous knowledge of what we value and can value wrongly, distorted, which reveals the complexity of the problem of guilt in general. Moreover, in philosophy, legal sciences and even theology, a unique concept of guilt is missing. Partly, this is explained by the fact that the concept of guilt is examined in philosophy through the prism of different philosophical schools; in religion, it was given an explanation of this term from the church teaching’s point of view, and in the legal sciences the notion of guilt is different in every area of law, which also has its own regulation. That is why it is important to delineate the general characteristics of the category of 'guilt' and a complete and in-depth analysis of this notion can bring us closer to elaborating the unique notion of this concept, or at least by drawing some common points of intersection. Thus, this article highlights the concept of guilt in philosophical thinking throughout history, prompting the ideas, even in contradiction of the most well-known philosophers of mankind.

Conceptul de vinovăție și problemele acesteia în contextul istoric demult fac obiectul discuțiilor în tratatele teologice, filosofice, psihologice, psihanalizei, în cercetările culturologice şi jurisprudenței. Vinovăția este atribuită în primul rând ființei umane, libere în spirit și act, deci ea poate să se facă vinovată cu vorba, fapta sau/ și gândul. Omul are gânduri vinovate - incompatibile cu valorile pe care le cunoaște, dar pe care nu doreşte să le trăiască; are cuvinte vinovate - rostite în adresabilitatea altor oameni; are fapte vinovate - săvârșite prin acțiuni ori inacțiuni, la fel incompatibile cu valorile pe care le cunoaște, dar pe care nu le voieşte și nu le trăieşte. În afară de faptul că orice cunoaștere e incompatibilă obiectiv și unilaterală subiectiv, noi putem avea o cunoaștere eronată a ceea ce valorizăm și putem valoriza eronat, deformat, ceea ce relevă complexitatea problematicii privind vinovăția, în general. De altfel, în filosofie, științe juridice șichiar teologie, lipsește un concept unic al vinovăției. Parțial, acest lucru se explică prin faptul că, în filosofie se analizează conceptul de vinovăție prin prisma diferitor școli filosofice; în religie s-a dat explicație acestui termen din punct de vedere a învățăturii bisericeşti, iar în științele juridice noțiunea de vinovăție este diferită în fiecare domeniu al dreptului, care are şi propria sa reglementare. Anume de aceea este importantă delimitarea caracteristicilor generale ale categoriei „vinovăției”, iar o analiză completă şi profundă a acestei noțiuni, ne poate apropie de elaborarea noțiunii unice a acestui concept, sau cel puțin trasând puncte comune de intersecție. Astfel, prezentul articol pune în evidență conceptul vinovăției în gândirea filosofică de-a lungul istoriei, determinând ideile chiar şi în contradictoriu a celor mai iluştri filosofi ai omenirii.
