Rezumat

The authors of the present article initiate a discussion concerning some theoretical and practical points of view on legal expertise in Republic of Moldova. It is proposed that on the pages of the journal there should be published scientific discussions on different types of legal expertise with critical elements both on the side of scientists and of practitioner-specialists, experts in establishing the truth in justice, and of other subjects interested in legal expertise. Forensic examination should be based on the realizations of modern science and practice, to be in excellence a laboratory work in the framework of some institutions of independent well equipped expertise. It is also important that these being public or private, to guarantee the autonomy of the expert during the implementation of the expertise. References are made to the main criteria of classification of expertises, resulting from the doctrine and legislation in force. It would be appropriate to carry out a comparative study of normative documents of different states of the world as to the classification or the categories of legal expertise. The authors consider to be appropriate the 12 classes of legal expertise provided by the legislation in force of the Republic or Belarus, which would serve as a good example for Republic of Moldova. The coordinating institution in the field of theory and practice of legal expertise and in the criminal law is the Centre of Legal Expertise under the Ministry of Justice of Republic of Moldova.
