Administrative Procedure Acts strengthen the rule of law and provide for a better procedural protection of the citizen’s rights. This is demonstrated by the example of the German federal Administrative Procedure Act. The guiding principles of administrative procedure under this act are informality, simplicity, appropriateness and quickness, the exclusion of officials in case of prejudice or conflict of interests, the initiation of the procedure ex officio or by application and the inquisitorial principle. The citizen has the right to be heard, the right to bring in representatives and advisors, the right to advice and information by the authority, the right of inspection of files and the right to secrecy. Administrative acts must be accompanied by a statement of reasons and a notification on available legal remedies. Under certain conditions, formal defects and procedural errors can be cured. |
