Hospital Acquierd Infection: Forensic Implication And Medico-Legal Argumentation Concerning Causality Hospital-acquired infection – also known as nosocomial infection – are dealt differently in Romanian legislation in spite of terminology of World Health Organization (WHO) or other renown medical institutions, there for, it creates divergence in forensic approach. Even if nosocomial infections reports are highest in the Mediterranean basin and Southeast Asia, we find that the frequency with which courts require, from authorized institutions in Romania, a forensic expert opinion on the implications of intra- hospital acquired infections in morbidity and mortality of patients is into a sharp increase. Or, in these circumstances, it requires a unified approach, concise, objective and consistent with legal issues in order to avoid possible conflicts of opinion between various forensic experts on the subject, as well as facilitating the relations between forensic institutions and the courts. In this paper we tempted to outline a position about the role of nosocomial infections in the chain that leads to death, specifying approach principles finalized at the Institute of Forensic Medicine Cluj, based on recent practice and the relevant legal provisions. Summing up the position of medical and legal provisions, the present study was able to highlight the main points of nosocomial infections sensitive issues, while providing legal solutions to overcome possible gaps of information or conflict situations that may occur. |
