The process of justice on civil cases develops in certain phases of procedural law, which in the knowledge of the civil process and in judicial practice are called the phases of the process. At each stage of the civil process the judge (the court) solves the goals and tasks of the corresponding phase inherent in it carrying out the civil procedural actions characteristic of this phase. The civil process follows several stages (phases): mandatory and optional. Required phases are: the instituting of the civil case, the preparatory part of the hearing, the judicial debates, the deliberation and the pronouncement of the court decision. Mandatory phases usually follow one another, with the exception of the procedure in an order that lacks one of the stages, namely judicial debates. The optional phases are: the appeal, the recourse and the review. In this broad spectrum of stages of the civil process, judicial debates have a leading role to guide and substantiate the final act of the civil process - the court decision |
