In this article it is concluded that art.13 of the Romanian Law on trade marks and trade of 30.05.1879
is a prototype of the provision stipulated at lett.a) par.1 art.83 of the Romanian Law No.84 on trade marks
and geographical indications, assuming the hypothesis of the usage without right of a trade mark for mis-
leading the public about the quality of products or services covered by the mark. It is argued the opinion
that the aim of art.41 of the Romanian Law No.28 on trade marks, trade and service from 27.12.1967
was to replace the regulative framework of the industrial property penal defense, represented at that time
only by art .5551 of the Penal Code dating 13.03.1936. And of course, it is revealed that art.78 and 79 of
the Romanian Law No.62 on inventions and innovations from 30.10.1974 are acts of criminal offenses
similar to those incriminated in art.299 and 300 in the Penal Code of Romania from 1968. This regula-
tive dualism affected negatively the application quality of the penal liability for acts against industrial
property, the invented ones.
